Buying a flat to rent out: what to check

The rules decide how you may use the home, and so what it can earn. These are the key points to settle before you buy a flat to rent out in Copenhagen.

Residence obligation

In Copenhagen, a home is subject to the residence obligation (bopælspligt) if it has been used as a year-round residence within the last five years. It must be lived in, and if it stands empty you must tell the municipality within six weeks of the last move-out. Short-term rental is only allowed for a limited number of days a year. Rent

In private rental homes built after 1991, landlord and tenant can agree the rent freely. For homes built before 1991, a number of rules govern how the rent is set. So do not count on market rent until you know what applies to that specific home.

The owners’ association’s articles

Under the standard articles, which apply unless the association has adopted its own, you must tell the board when you rent out the whole flat. The association can ban short-term rental, but you may still rent it out up to four times and no more than 30 days in total a year. Read the articles before you bid.

Tax

If you rent out a home you own but do not live in for at least 12 months, it counts as commercial rental. Any profit is personal income, you must keep accounts, and in most cases you can use the business tax scheme. Always have your own case confirmed by an accountant.

Size and location

There is a market for every size of flat, but location often matters most. Read about the size of a short-term rental and favourable locations.

Check what your insurance covers once the home is rented out, and make sure the cover matches how the flat is used.

Can you buy a flat in Copenhagen and rent it out?

Yes, but check the residence obligation first. A home that has been used as a year-round residence within the last five years must be lived in, for example by a tenant who lives there permanently. If it stands empty, the municipality must be told within six weeks of the last move-out. Check rent rules, the association’s articles and tax too.

How is rental income from an investment flat taxed?

Can I rent out my investment flat on Airbnb?

Only to a limited extent. Short-term rental is only allowed for a limited number of days a year, and the owners’ association may have restricted it. If the home is subject to the residence obligation, it must also be lived in permanently, and short-term guests do not count as residents. That is why many landlords choose long-term rental as their main model.

Yes. Long-term rental costs 8.5% of the monthly rent including VAT, and Airbnb management costs 17% of rental income. Cleaning, linen, supplies and maintenance are billed separately at cost or agreed rates, and there are no hidden fees. Every month you get a statement of income and costs.
