Can you send a tenant notice to quit or a payment demand digitally?

Not yet. Today, a formal demand for payment (påkrav), your notice to quit (opsigelse) and the tenant's objection to that notice (indsigelse) must be sent by letter, even though the rest of the communication in the tenancy may well take place by email (§ 13 of the Rent Act, in Danish). A bill, L 34, would make it possible to send them digitally from 1 January 2027, if you and the tenant have agreed to it, if it goes through a secure digital post service with MitID that the tenant has chosen, and if the notice arrives between Monday 8:00 and Friday 16:00. The bill had its first reading in the Danish Parliament (Folketinget) on 20 October 2026 and has not been passed.

What can you send to your tenant by email today?

Almost everything. Under § 13(1) of the Rent Act (lejeloven), the starting point is that notices in a tenancy can be sent as digital documents, and according to the explanatory notes to bill L 34 (in Danish), no agreement is needed. Either you or the tenant can, however, demand that notices are not sent digitally, giving 1 month's notice to the first day of a month that is not a public holiday. If one of you is exempt from Digital Post, notices cannot be sent digitally at all.

Three notices are excluded. Under § 13(2) (in Danish), notices under § 176 and § 182(2) cannot be given as digital documents. They are:

  • your payment demand when the rent has not been paid on time (§ 182(2)),
  • your notice to quit under § 170, no. 2 and 3, or § 171, for example when you want to move back into your owner-occupied apartment yourself (§ 176(1)),
  • the tenant's written objection to the notice (§ 176(2)).

The guidance to standard form A (typeformular A, in Danish), the standard lease, says the same: as a rule, the parties can communicate digitally, but payment demands, the landlord's notice to quit and the tenant's objection cannot be given as digital documents. The move-in report may be handed over digitally (§ 90(2)).

What does the bill change?

The bill makes it possible to send payment demands and notices to quit digitally, but only on certain conditions. It amends § 13 so that notices under § 176 and § 182(2) can only be sent as digital documents by agreement between tenant and landlord and through a secure digital post provider designated by the tenant (L 34 as introduced, in Danish). Nobody will be obliged to communicate digitally.

Four conditions for sending digitally

  1. An agreement between you and the tenant. It can be written into the lease or made later. According to the explanatory notes, the agreement is unrelated to the rest of the tenancy, so neither of you can make it a condition for entering into the lease. Where there are several tenants, they cannot require that some receive letters and others digital post.
  2. A secure digital post provider chosen by the tenant. The notes describe this as a digital platform with end-to-end encryption, where you log in to the provider's viewing client with MitID. Ordinary email does not count: if you have agreed on email, the notice is treated as not having been given. If you do not want to use the service the tenant names, you cannot make the agreement.
  3. Equal terms. The agreement must not put the tenant in a worse position than you. So you cannot agree that you send payment demands digitally unless the tenant can send an objection to you the same way.
  4. Neither of you is exempt from Digital Post. This also applies if only one of several tenants is exempt.

Both parties can still opt out of digital communication with 1 month's notice, and then you are back to letters, the ministry writes in its press release on the bill (in Danish).

The time window: from Monday 8:00 to Friday 16:00

Your payment demands and notices to quit must be received by the tenant between Monday 8:00 and Friday 16:00, and notices received on a public holiday or Christmas Eve are invalid (the proposed § 13(3)). According to the notes, in a week with a public holiday or Christmas Eve, the notice must also not arrive between 16:00 the day before and 8:00 the day after, if that is a weekday. The rule cannot be set aside by agreement.

  • Received means that the notice has reached the tenant's digital viewing client. The time of sending is not what counts.
  • You carry the risk of delivery, including if delivery is delayed.
  • If a payment demand or notice to quit arrives outside the time window, it is invalid, and you cannot rely on its content.
  • The tenant may send an objection to you at any time.

An example: if you send a payment demand at 15:55 on a Friday and it only arrives at 16:05, it is invalid. The text of the bill only mentions Monday 8:00 and Friday 16:00, not a daily window, but send early on an ordinary weekday anyway, so you have a margin.

Where does the bill stand now?

The bill has been introduced and had its first reading, but it has not been passed. It has been under way for more than a year:

  • 25 June 2025: The government at the time (Social Democrats, Venstre and the Moderates), the Socialist People's Party and the Conservatives made a political agreement on digital communication in private tenancies. The ministry announced it on 2 July 2025 (Ministry of Children, the Elderly and Housing, in Danish).
  • 15 January 2026: The bill was introduced as L 96, with entry into force on 1 July 2026. It had its first reading on 5 February 2026 and lapsed when a general election was called on 26 February 2026 (Folketingstidende, in Danish and the consultation letter on Høringsportalen, in Danish).
  • 4 to 18 September 2026: An amended bill went out for a renewed public consultation with the new time window, so that tenants cannot receive these particularly burdensome notices at weekends or on public holidays. After the consultation, Christmas Eve was added.
  • 7 October 2026: The Minister for Children, the Elderly and Housing, Jacob Mark, reintroduced the bill as L 34. It had its first reading on 20 October 2026 and has been referred to committee (Folketingstidende, in Danish).

The law is proposed to enter into force on 1 January 2027. Until a passed law has entered into force, § 13 applies as it does today, and the bill may still be amended in committee. So only write an agreement on digital payment demands into your leases once the law has been passed, and use the wording the law ends up with.

How to write the agreement into the lease

Standard form A, 10th edition, currently has no field for an agreement on digital payment demands and notices to quit. There are fields for both your email and the tenant's in § 1, and the guidance on digital communication sits with § 11 on special terms. The guidance recommends that an annex to the lease is signed separately (standard form A, in Danish). There is more on the form in our guide to the lease agreement, standard form A10.

Once the law has been passed, we recommend making the agreement a separate annex that the tenant signs on its own, and referring to the annex in § 11. That shows the agreement is voluntary and not a condition of the tenancy. As a minimum, the annex should state:

  • which notices it covers: payment demands under § 182(2), notices to quit under § 176 and the tenant's objection,
  • the secure digital post service the tenant has chosen, and how each of you reaches the other there,
  • that the tenant can send notices to you the same way,
  • the names of all tenants covered by the agreement,
  • that neither of you is exempt from Digital Post,
  • that each of you can opt out of digital communication with the notice in § 13(1), so that notices go by letter again.

Until 2027: send payment demands and notices to quit by letter

Until a new law applies, payment demands and notices to quit must be sent on paper, and you must be able to show that they arrived. The tenant's deadlines run from the time the notice reached them (§ 176(2) and § 182(2)).

Under § 182(2) of the Rent Act (in Danish), a payment demand must:

  • be given no earlier than after the 3rd weekday after the last day for paying on time, and if that weekday is a Saturday or Constitution Day, no earlier than the following weekday,
  • state expressly that the tenancy can be terminated if the arrears are not paid before the deadline,
  • give the tenant 14 days from the time the demand arrived. If the deadline falls on a public holiday, a Saturday or Constitution Day, it moves to the following weekday.

You can charge a fee for the payment demand. The amount is DKK 287 at 2021 level and is adjusted once a year.

A notice to quit under § 170, no. 2 and 3, or § 171 must be in writing and tell the tenant about the right to object. If you give notice under § 171, the reason must also be stated. If the information is missing, the notice is invalid (§ 176(1)). The tenant has 6 weeks to object in writing, and if you want to uphold the notice, you must bring a case before the housing court (boligretten) no later than 6 weeks after the tenant's deadline (§ 176(2)). Notice periods and formal requirements are covered in our guide to giving notice on a rental home. A fixed-term lease ends without notice when the term expires (§ 173). See fixed-term lease.

Send the letter so you can document that it arrived, for example by handing it over in person against a receipt or with a tracked delivery, and keep a copy of what you sent. You are welcome to email a copy for information, but the letter is what counts.

What happens if the payment demand is sent the wrong way?

Then you cannot terminate the lease because of the arrears. Under § 182(2), you can only terminate for late payment if the tenant has not paid within 14 days after a written payment demand arrived, and a demand sent by email does not meet § 13(2). The same goes for a demand that does not state expressly that the tenancy can be terminated. Send a new, correct demand by letter. The 14 days then run from the time it arrives.

If the bill is passed, something similar applies to digital demands. According to the notes, a demand that arrives outside the time window is invalid, and a demand sent by ordinary email is treated as not having been given.

Checklist for landlords

  • Write both your email and the tenant's in § 1 of the lease, so ordinary notices can be sent digitally.
  • Send payment demands and notices to quit by letter until a new law has entered into force.
  • Check the deadlines: a demand no earlier than after the 3rd weekday after the last day for paying on time, and 14 days to pay.
  • State expressly in the demand that the tenancy can be terminated, and in the notice to quit that the tenant can object.
  • Keep a copy and proof that the letter arrived.
  • Follow bill L 34, and only make an agreement on digital payment demands once the law has been passed.
  • After that, use only the secure post service the tenant has chosen, never ordinary email, and send only between Monday 8:00 and Friday 16:00, avoiding public holidays and Christmas Eve.
  • Never make the agreement on digital communication a condition for getting the tenancy.

Can I send a payment demand to my tenant by email?

No, not today. Under § 13(2) of the Rent Act, payment demands under § 182(2) cannot be given as digital documents. A demand sent by email does not start the 14-day deadline, and you cannot terminate the lease on the basis of it. Send the demand by letter and keep proof that it arrived.

When can notices to quit and payment demands be sent digitally?

From 1 January 2027 at the earliest, if the Danish Parliament passes bill L 34. It was introduced on 7 October 2026 and had its first reading on 20 October 2026, but had not been passed by 28 October 2026. An earlier bill, L 96, lapsed with the general election in February 2026. Until a new law enters into force, the letter requirement applies.

What is a secure digital post provider?

According to the explanatory notes to the bill, it is a digital platform where messages are protected by end-to-end encryption and where you log in to the provider's viewing client with MitID. The tenant chooses the provider. Ordinary email does not meet the requirement, and a notice sent by ordinary email is treated as not having been given.

When may a landlord send a digital payment demand under the new rules?

Under the bill, the demand must be received by the tenant between Monday 8:00 and Friday 16:00. If it arrives on a public holiday or Christmas Eve, it is invalid, and in weeks with a public holiday it must also not arrive between 16:00 the day before and 8:00 the day after. The landlord carries the risk of delays.

Can I require an agreement on digital communication before letting to a tenant?

No. According to the explanatory notes to bill L 34, the agreement is unrelated to the rest of the tenancy, and neither party can make it a condition for entering into the lease. Nor may the agreement put the tenant in a worse position than you, so the tenant must be able to send an objection to you the same way.

What applies if the tenant is exempt from Digital Post?

Then notices in the tenancy cannot be sent as digital documents at all under § 13(1) of the Rent Act. This also applies under the bill, and it applies even if only one of several tenants is exempt. All notices must then be sent by letter.
